BCET Tutoring Agreement
BCET is a Tennessee establishment that provides one-on-one tutoring services designed to improve students’ academic performance. Parent(s) wish(es) to engage the tutoring services of BCET, and BCET wishes to provide such tutoring services to Student. Both parties wish to set forth their respective rights and responsibilities in this Agreement. WHEREAS, in recognition of the mutual terms and conditions set forth herein, it is hereby agreed to as follows:
Nature of Agreement. The Agreement of the parties includes the provisions of this signed document, and any following Appendices (collectively referred to as the “Agreement”).
Term and Scope of Agreement
This Agreement shall commence upon the earlier of the first date on which BCET performed services or the date set forth next to the signatures of the Parties, or such other effective date as agreed to by the parties. To the extent that any work is performed based upon an initial verbal understanding, and that an eventual definitive written agreement is not executed, BCET is entitled to compensation for its work based upon the Session Rates set forth herein.
This Agreement shall continue in force between the Parties until the end of the school year, unless sooner terminated pursuant to the terms of this Agreement. Upon the termination of the initial term, this Agreement will automatically renew on a monthly basis. At any time, Parent may discontinue tutoring services, without penalty, provided that all payment for services rendered to-date has been received.
Services to be Performed
SCOPE OF TUTORING SERVICES
BCET shall provide education services in a variety of content areas and in learning-related skills such as study strategies, organization, motivation, and confidence. The Scope of Tutoring may be amended from time to time as agreed upon by the Parties.
Tutoring sessions are forty-five (45) minutes for in-home and fifty (50) minutes for on-line. Each session can be extended at the Parent(s) or Student’s request, tutor’s schedule permitting.
Parent(s) will be provided with regular updates on the Student’s progress.
The rate for each session type is listed below in the rate schedule table. These rates include all travel time, basic preparation (e.g., 10 minutes per session) and initial telephone and e-mail communication with parents.
In-home Tutoring Extensions (e.g. adding extra time to an existing tutoring session) and Phone or Online Tutoring are billed at the Direct Instruction Rate. Extensions to in-home tutoring and phone or online tutoring (live conversation between tutor and student) are billed in 1/4 session increments. Any phone tutoring session between the Student and Tutor that is less than 10 minutes is complimentary.
E-mails between tutors and parents are always complimentary. Phone calls between parents and tutors or parents and BCET staff that are less than 1/2 session (30 minutes) are complimentary. Phone calls greater than 1/2 session (30 minutes) will be billed at Direct Instruction Rates.
From time to time parents may request that tutors or BCET staff meet with teachers, school administrators or other support personnel. These meetings may occur either in-person, on the phone, or online. Parents will be invoiced Direct Instruction Rate for Tutors and Case Management Rates for BCET Staff based on the length of the meeting (meeting lengths are billed in 1/4 session increments). Parents may wish to fill out a Tutor Service Authorization Form to authorize additional services.
TUTOR AUTHORIZATION FORM
Parents may be invoiced for services authorized in this contract even if they have not filled out the Tutor Service Authorization form. The Tutor Service Authorization form is simply a convenient tool designed to increase communication between parents, tutors and BCET staff.
Parents may also request tutors to spend extra time grading material, designing assessments or building specialized curriculum. These types of activities are considered additional “Prep” and are billed at “Prep Rate” (Current Prep Rate is $55 or 1/2 of Direct Instruction Rate).
Customized Tutoring Programs. Special arrangements will be made with Parent(s) engaging BCET in the provision of semester-long course work, home schooling programs or other customized tutoring programs that necessitate additional and/or ongoing preparation, evaluation and communication with outside parties including but not limited to teachers, school administrators, psychological/educational evaluators, psychiatrists, learning and behavioral specialists and other professionals. In such instances, Parent(s) and BCET will agree, in advance, to a ratio of preparation-to-delivery time expectations and additional case management fees that may apply. Preparation time will be billed at half the Direct Instruction Rate.
Invoices will be generated immediately after receiving service and sent to the email address provided. EFT and credit card payments are processed automatically. All invoice payments are due upon receipt. Late payments on invoices will be assessed a thirty dollar ($30) late fee if payment on an invoice is not received within 30 days. Late invoices will continue to accrue late fees for every successive thirty (30) day period that payment is not received.
Dual, group tutoring, and customized program rates are available upon request.
Parent or Student shall not, during the term of this Agreement and for a period of one (1) year immediately following the termination of this Agreement, or any extension of it, for any reason, either directly or indirectly solicit or attempt to solicit the services of any tutor(s) provided by BCET for their personal use or for any other person or entity with which Parent or Student has an association. BCET shall own all worldwide right, title, and interest in and to any intellectual property existing or created by tutor in the process of performing tutoring services under the Agreement.
In the event of illness or a family emergency we require twenty-four (24) hours advance notice for a cancellation. If clients cancel sessions less than 24 hours in advance (but more than 6 hours before the tutoring session) they will be charged ½ the full session rate for each session booked. For example, if a family has booked two standard tutoring sessions with a tutor the same afternoon, they will be billed 50% of the two sessions for the late cancellation. If a family has booked one session they will be charged 50% of 1 tutoring session. If clients cancel sessions less than 6 hours before the scheduled tutoring session they will be charged the full session rate.
If Student arrives more than fifteen (15) minutes late for a scheduled session that will be considered a No-Show and the full Session Rate will be charged. Whether any academic counseling is provided to Student during the remainder of the Session time is within the sole discretion of the Tutor.
IN WITNESS WHEREOF, each party has caused this Agreement to be executed individually or by its duly authorized representative effective as of the date first written. By typing my name and e-mail and submitting this contract online I am affirming that I understand and authorize all of the above.
